Term And Condition

1. Definitions

“Company” means Ajk travel Derby, a licensed PSV operator.
“Customer” means the person or organisation making the booking.
“Vehicle” means the minibus or coach provided.
“Driver” means a qualified driver holding a valid PCV licence.
“Hire Period” means the agreed time for the booking.

2. Operator Licensing and Compliance

The Company operates under a valid PSV Operator’s Licence issued by the Traffic
Commissioner.
All services comply with regulations set by the Driver and Vehicle Standards Agency and
Traffic Commissioners for Great Britain.
Vehicles are maintained in a roadworthy condition and inspected in accordance with UK
law.
Drivers hold:
A valid PCV (Category D1/D) licence
A valid Driver CPC (Certificate of Professional Competence)
Compliance with driver hours regulations

3. Bookings and Payment

Bookings are subject to availability and confirmation.
A deposit of 25% may be required.
Full payment must be received at least 7 days before travel.
Prices are quoted based on:
Journey details provided at the time of booking
Driver hours and legal rest requirements
Additional charges may apply for:
Extended waiting time
Route changes
Additional mileage

4. Driver Hours and Legal Restrictions

5. Passenger Safety and Conduct

Seat belts must be worn where fitted, in accordance with UK law.
The Customer is responsible for passenger behaviour.
The Driver may refuse travel or terminate the journey if:
Passengers are abusive, intoxicated, or unsafe
Passenger numbers exceed legal capacity
No smoking or vaping is permitted in the vehicle under UK law.

6. Use of Vehicles

Vehicles may only be used for the agreed hire purpose.
Standing passengers are not permitted unless the vehicle is specifically licensed for it.
The Company reserves the right to substitute vehicles of similar capacity if necessary.

7. Cancellations and Refunds

All cancellations must be made in writing.
Cancellation charges:
More than 14 days : deposit retained
[7-14 days]: 30 % charge
Less than 2 days : full charge
The Company may cancel due to:
Safety concerns
Vehicle breakdown
Driver illness
In such cases, a refund or alternative will be offered.

8. Delays and Liability

The Company will make every reasonable effort to operate on schedule.
The Company is not liable for delays caused by:

Traffic congestion
Weather conditions
Road incidents
Compliance with legal driving hours
The Company shall not be liable for indirect or consequential losses (e.g. missed flights or
events).

9. Insurance and Liability

The Company maintains:
Motor insurance covering passengers as required by UK law
Public liability insurance
Personal belongings are carried at the Customer’s own risk.
The Company is not liable for loss or damage unless caused by proven negligence.

10. Breakdowns and Service Interruptions

In the event of breakdown or emergency:
The Company will arrange alternative transport as soon as reasonably possible
Compensation is limited to the cost of the affected portion of the journey.

11. Accessibility and Equality

The Company complies with the Equality Act 2010.
Reasonable adjustments will be made for passengers with disabilities where possible.
Wheelchair-accessible vehicles must be requested at the time of booking.

12. Lost Property

Any lost property found will be held for 14 days.
Return of items may incur postage or handling fees.

13. Force Majeure

The Company is not liable for failure to perform due to events beyond its control,
including:
Severe weather
Industrial action
Government restrictions

14. Governing Law

These Terms and Conditions are governed by the laws of England and Wales.
Any disputes will fall under the jurisdiction of UK courts.

15. Acceptance

By confirming a booking, the Customer agrees to these Terms and Conditions.
